Please read this agreement carefully. You are responsible for having agreed to its terms, policies, and disclaimers, whether or not you read or remember them:

As a pre-requisite of making an appointment through this website and/or with Ask My Pet (hereafter "AMP"), its owners, agents, or employees directly, you (i) agree to the following terms and conditions and (ii) represent that you are 18-years-of-age or older.

What This Agreement Covers:

You also agree that the terms of this agreement govern any and all current or future consultations with Ask My Pet, its owners, agents, and/or employees, including but not limited to appointments made via website, e-mail, telephone, or any other method.

Payment (excluding one free, 10-minute introductory phone conversation) must be received by AMP via Paypal, Venmo or check in advance of to your appointment. Remember: additional work requested after your initial payment/time has been used up, will be billed at 10-minute increments of $40 each for conversations with your pet and 15-minute increments of $75 each for emotional and spiritual clearings. These fees are due prior to any additional services being rendered.

Cancellation: You agree to pay a $25 cancellation fee for any appointment cancelled less than 24 hours in advance. To avoid this fee, your cancellation must be received at least 24 hours prior by e-mail. Also note that because of recent changes in PayPal's financial policies, if a client has paid for a session and then cancels or if a refund is made for any reason, I am still charged PayPal's standard merchant fee percentage. In the event you cancel a paid session or a refund is issued for any other reason, this fee will be deducted from the amount returned to you.

Privacy Policy: The terms of this website's privacy policy are incorporated herein.

In agreeing to retain AMP's services, you also acknowledge, understand and agree that:

  • AMP and its owners, agents, and employees are not veterinarians or medical professionals of any kind or degree. Using the services of AMP and its employees/owners is for entertainment value and is not a substitute for seeking the advice, opinions and/or treatment of a medical professional for your pet.
  • AMP may decline to provide you with their services even if payment is timely made, in which case you will receive a full refund of your payments for which no services were provided.
  • If you suspect that your animal is ill, injured, dangerous, or having a medical crisis you should seek help from a qualified veterinarian.
  • While you may see physical improvement in your animal, the work Ask My Pet and its owners, agents, and employees does is emotional and spiritual in nature, not medical.
  • Your animals, like humans, have free will in regard to their behavior and condition and that the animal's behavior and/or condition may fluctuate or even worsen, despite our sessions. (Again, they are very much like humans in this regard!)This service is provided for entertainment purposes only and no guarantees are implied or stated.

Disclaimer of Warranties; Exclusions: You understand and agree that AMP's services are provided "as is" and without any kind of warranty or guarantee express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Release of Liability:

You agree to hold Ask My Pet and its owners, employees, and agents, harmless (meaning not liable financially, legally or emotionally) for your animal's actions, mental, or physical state. You understand and agree that this release extends as well to any claims a third party to this agreement may have against you or AMP, its owners and/or employees, and agents in relation to your animal and/or AMP.

You further release Ask My Pet, its owners, employees, and agents from any and all tort claims or demands, tort losses and/or damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with disputes under this agreement and/or any services rendered or statements made in connection with your animal(s).

This release includes but is not limited to any injury your animal may do to another animal, itself, to property, or to any human being. If you are a California resident, you also waive California Civil Code section 1542, which says: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR."

Release of Liability relating to Third Parties: You acknowledge that this site's owner does not warrant that this site, its servers, or e-mail sent from this site are free of viruses or other harmful components. You also agree that the site owner will not be liable for any damages of any kind arising from the use of this site, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Limitation of Actions Deadline: You agree that any cause of action arising out of or related to services provided to you and/or your animal by Ask My Pet, its owners and employees must be commenced within six (6) months after the cause of action allegedly arose (except for causes of action arising out of Users' responsibilities in the Indemnification section below); otherwise, such cause of action is permanently barred.

Indemnification: You irrevocably agree to defend, indemnify and hold Ask My Pet, its owners and employee, harmless from and against all claims, fees, losses, costs, liabilities, expenses, settlements, and/or judgments, including without limitation, reasonable attorneys' fees, that may result from any claims or demands asserted by any third party in connection with your use of any and all services performed by Ask My Pet, its owners and/or employees.

Liquidated (Limited by Contract) Damages: the event of an alleged breach of this contract by Ask My Pet, you agree that actual damages would be difficult to ascertain with reasonable certainty. You therefore agree that in the event Ask My Pet, its owners or employees were found to have breached this contract in any way, any and all damages (consequential, incidental or compensatory) would be limited to a total of $50, which you also agree represents a reasonable estimate in relation to any damage that might be done. You acknowledge that this agreed-upon amount, $50, represents your sole and exclusive remedy against Ask My Pet, its owners and/or employees in the event that you were to prevail in any action arising out of services contracted for or provided to you.

No other Assurances: You understand that these terms constitute the complete and exclusive agreement between you and Ask My Pet. You agree that it replaces and cancels any and all prior or contemporaneous agreement, oral or written, and any other communications, representations, w and understandings related to the subject matter of this agreement.

No Oral Modifications: To be effective, the parties agree that any modification must be in writing signed by Ask My Pet. Oral modifications of this agreement shall not be binding.

Waivers and Ask My Pet: Ask My Pet shall not be deemed to have waived any rights or remedies under this agreement or under law, unless such waiver is in writing and signed by Ask My Pet. You agree that no delay or omission on the part of Ask My Pet in exercising any rights or remedies under this agreement shall operate as a waiver of such rights or remedies.

Governing Law; Jurisdiction: You agree that this agreement shall be governed by and enforced in accordance with the laws of the state of California, without regard to its conflicts of law principals. You also agree that any dispute or action related to this agreement must be filed in the courts of Los Angeles County California, only, and that you agree to waive any and all jurisdictional, venue or inconvenient forum objections.

No Class Claims; Waiver: You agree that there shall be no class claims, consolidation, or joinder allowed in any dispute between the parties to this agreement and that no claim may be made through an action purporting to represent a class of Site users or otherwise asserting claims on behalf of a class.

Attorneys Fees: In the event Ask My Pet, including its owners, agents, and/or employees, consults or retains an attorney to enforce the terms of this agreement or defend against any dispute arising from your work together, you agree to pay without limitation, all reasonable attorneys fees incurred.
